TERMS OF SERVICE

Effective Date: November 10, 2025
Website: stacksweller.com

1) Agreement

By using Stack Sweller, you accept these Terms. If you don't agree, don't use the service.

2) What Stack Sweller Does

Stack Sweller is a paid SaaS that gives Substack users tools like scheduling, finding notes, and idea management.

3) Accounts

You need an email and password to use Stack Sweller.

When you connect your Substack account, Stack Sweller acts as your authorized tool to schedule and publish content on your behalf. You remain in full control of what gets posted and when.

You're responsible for ensuring your use of automation tools complies with third-party platform policies. Stack Sweller provides the technology; you decide how to use it within the rules of platforms you connect.

You're responsible for your account security and all activity on your account. We can suspend or terminate accounts that violate these Terms or law.

4) Plans, Trials, Billing, Cancellations, Refunds

  • Paid monthly or yearly. Optional 7-day free trial.
  • We use LemonSqueezy for checkout and subscription management.
  • Subscriptions auto-renew until you cancel.
  • You can cancel anytime. When you cancel, you keep access until the end of the paid period.
  • No refunds after a charge goes through (including renewals and trials that convert).
  • Prices and features can change. If they do, we'll post an update or notify you.
  • Taxes may apply.

5) User Content vs. Our IP

  • You own your content and data (including anything pulled from or tied to your Substack).
  • We own Stack Sweller: software, features, UI, designs, documentation, and trademarks.
  • You give us a limited license to process your content solely to provide the service.

6) Acceptable Use

Don't do any of this:

  • Break laws or rights.
  • Attempt to access data you don't own or have rights to.
  • Reverse engineer, scrape, or bypass security.
  • Spam, abuse, or overload the system.
  • Use the product to build a competing service using our confidential info.
  • Use Stack Sweller to circumvent any Substack policies, payment systems, or access restrictions. You are responsible for ensuring your content and posting practices comply with all applicable platform policies.

7) Third-Party Platforms and Providers

  • Substack is a separate platform. We don't control it. You must follow Substack's terms and policies.
  • Payments are processed by LemonSqueezy. We don't store card numbers.
  • Email is sent via MailerLite.
  • Authentication and storage run on Supabase.
  • We're not responsible for outages, data handling, or actions by Substack, LemonSqueezy, MailerLite, Supabase, or any other third party.

Substack Compliance: You acknowledge that your use of Stack Sweller to interact with Substack must comply with all Substack policies and terms. If Substack changes its policies regarding third-party tools or automated posting, we may need to modify or discontinue features. We are not liable if Substack suspends, terminates, or restricts your account due to your use of Stack Sweller.

8) Force Majeure

We aren't liable for delays or failures caused by events we can't reasonably control: internet or hosting failures, third-party outages, DDoS, power issues, strikes, government actions, new regulations, epidemics, natural disasters, or similar events.

9) Service Changes and Availability

We may add, change, or remove features. We aim for reliable uptime, but service may be interrupted for maintenance, updates, or issues outside our control.

10) Disclaimers

The service is provided "as is" and "as available." No warranties of any kind, express or implied, including merchantability, fitness for a purpose, non-infringement, or non-interruption. We do not guarantee continued compatibility with Substack or any third-party platform. Changes to Substack's API, authentication methods, or policies may affect Stack Sweller's functionality.

11) Limitation of Liability

To the maximum extent allowed by law:

  • We're not liable for indirect, incidental, special, consequential, or punitive damages.
  • Our total liability for any claim is limited to the amount you paid to us in the 3 months before the claim.

12) Indemnity

You'll indemnify and hold us harmless from claims, damages, and costs arising from your content, your use of the service, your breach of these Terms or law, or any violation of third-party platform terms (including Substack) resulting from your use of Stack Sweller.

13) Communications

By creating an account, you agree to receive transactional emails (receipts, security alerts, product updates). You can opt out of marketing emails at any time. Transactional emails are required to operate your account.

14) Age Requirement

You must be 18 or older to use Stack Sweller.

15) Governing Law; Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. If any dispute arises, you agree to resolve it in the state or federal courts located in New Castle County, Delaware. Each party waives class actions and agrees to bring claims only in an individual capacity.

16) Changes to These Terms

When we update Terms, we'll post the new version with a new Effective Date. Continued use means you accept the changes.
